1. Acceptance of Terms
Terms of Service and Disclaimer
By downloading, installing, or using the Hear It, Learn It mobile application ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.
2. In-App Purchases and Advertisements
2-1. Premium Upgrade
The App offers an in-app purchase, the Premium Upgrade, which unlocks unlimited Decks and Flashcards and removes all advertisements. This purchase is a one-time, non-consumable purchase processed through the App Store.
2-2. No Refunds
All sales of the Premium Upgrade are final, and the App Store handles refund requests according to their policy.
2-3. Advertisements
You acknowledge that the free version of the App contains advertisements. Purchasing the Premium Upgrade removes these ads.
3. Disclaimer of Warranty
The App is provided "as is" and "as available" without warranty of any kind. We do not warrant that the App will meet your requirements, nor do we guarantee specific study results, academic success, or the accuracy of your imported content or TTS generation. You assume all risks associated with the use of the App.
4. IP and User Content
4-1. App IP
The App, its design, source code, and all content provided by the developer are our property. You may not copy, modify, or distribute any part of the App without written permission.
4-2. User Content
You retain ownership of all Flashcards and content you create and store in the App. You are solely responsible for the legality and appropriateness of the content you upload or record.
5. Governing Law, Dispute Resolution, and Arbitration
5-1. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. However, concerning consumer protection laws in the user's jurisdiction which cannot be excluded by agreement, those laws shall prevail.
5-2. Jurisdiction
You and the Company agree that any dispute, claim, or controversy arising out of or relating to these Terms or the App (collectively, "Disputes") will be settled by **mandatory and binding arbitration**. **You are giving up the right to go to court and to have a trial by jury**, and you waive your right to participate as a class representative or class member in a **class action or representative proceeding.**
The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The Federal Arbitration Act (FAA) shall govern the interpretation and enforcement of this arbitration provision.
Notwithstanding the foregoing, either party may bring an individual action in **small claims court** in your county of residence or in Japan, provided the action remains in that court.
